Terms of Use for Bedrock Commander

1. Acceptance of Terms

Welcome to Bedrock Commander! By accessing or using our Minecraft Bedrock Server GUI application and website (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Bedrock Commander ("we," "us," or "our").

2. Eligibility

2.1 Age Requirements

You must be at least 13 years old to create an account and use the Service
If you are under 18, you must have permission from a parent or legal guardian
Parents/guardians who permit minors to use the Service agree to be bound by these Terms and are responsible for the minor's use

2.2 Account Authority

By creating an account, you represent and warrant that:

You have the legal capacity to enter into these Terms
All information you provide is accurate and current
You will maintain the accuracy of such information

3. Account Registration and Security

3.1 Account Creation

You must provide a valid email address to create an account
You are responsible for maintaining the confidentiality of your password
You agree to notify us immediately of any unauthorized use of your account
We reserve the right to refuse service or terminate accounts at our discretion

3.2 Account Security

You are solely responsible for all activities that occur under your account
We are not liable for any loss or damage arising from your failure to maintain account security
We recommend using a strong, unique password
Never share your login credentials with others

3.3 Account Termination

You may terminate your account at any time within the /accounts page.
If you're concerned there was a problem where it hasn't been fully deleted contact us at support@nerdherdmc.com.
We will ensure your account information has been properly terminated and deleted as you request.
Upon termination:

Your access to premium features will immediately cease
Your data will be deleted in accordance with our Privacy Policy
Subscription fees are non-refundable (see Section 5)

4. Description of Service

4.1 Free Features

Bedrock Commander provides basic Minecraft Bedrock server management tools at no cost, including:

Server console access and log viewing
Basic server control functions
Account management

4.2 Premium Features

Premium subscription includes additional features:

Advanced notification system with customizable alerts
Sound notifications for server events
Enhanced server monitoring tools
Priority support
Additional features as announced

4.3 Service Modifications

We reserve the right to:

Modify, suspend, or discontinue any aspect of the Service at any time
Change feature availability between free and premium tiers
Add or remove features with or without notice
We will make reasonable efforts to notify users of significant changes

5. Subscription and Payment Terms

5.1 Premium Subscription

Premium subscriptions are billed monthly through Stripe
Pricing is displayed at the time of purchase and may change with notice
Subscriptions automatically renew unless canceled
You authorize us to charge your payment method for recurring subscription fees

5.2 Payment Processing

All payments are processed securely through Stripe
We do not store your credit card information
You are responsible for providing accurate payment information
Failed payments may result in suspension of premium features

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings
Cancellations take effect at the end of the current billing period
You retain access to premium features until the end of the paid period
Subscription fees are non-refundable except as required by law
No refunds for partial months or unused portions of the service

5.4 Free Trials and Promotions

We may offer free trials or promotional pricing at our discretion
Trial periods may require payment information upfront
Trials automatically convert to paid subscriptions unless canceled
Promotional terms will be specified at the time of the offer

6. Acceptable Use Policy

6.1 Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically:

Managing your Minecraft Bedrock servers
Monitoring server logs and performance
Configuring notifications and alerts
Using features as intended and documented

6.2 Prohibited Activities

You agree NOT to:

Security and System Integrity:

Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Introduce viruses, malware, or harmful code
Bypass security features or authentication measures
Reverse engineer, decompile, or disassemble the software

Abuse and Misuse:

Use the Service to violate any laws or regulations
Impersonate others or misrepresent your affiliation
Harass, abuse, or harm others through the Service
Spam, phish, or send unsolicited communications
Use automated systems (bots) without permission

Intellectual Property:

Copy, modify, or distribute our software without permission
Remove copyright or proprietary notices
Create derivative works based on the Service
Resell or commercially exploit the Service

Resource Abuse:

Overload our systems with excessive requests
Use the Service for cryptocurrency mining
Employ the Service for any form of automated data collection
Share accounts or subscription access with unauthorized users

6.3 Minecraft and Microsoft Terms

You must comply with Minecraft End User License Agreement (EULA)
You must comply with Microsoft Terms of Service
Bedrock Commander is not affiliated with or endorsed by Mojang or Microsoft
You are responsible for your Minecraft server's compliance with applicable terms

7. Intellectual Property Rights

7.1 Our Rights

All content, features, and functionality of the Service are owned by Bedrock Commander and are protected by:

Copyright laws
Trademark laws
Patent laws
Trade secret laws
Other intellectual property rights

This includes but is not limited to:

Software code and architecture
Design, graphics, and user interface
Text, documentation, and tutorials
Logos, trademarks, and branding
Sound files and notification assets

7.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the Service for personal or internal business use
Download and use the desktop application on authorized devices
Use premium features if you have an active subscription

This license does NOT permit you to:

Redistribute or resell the Service
Modify or create derivative works
Use the Service for commercial purposes beyond managing your own servers
Remove or alter any proprietary notices

7.3 User-Generated Content

You retain ownership of any data you input into the Service (server configurations, notification settings, etc.). By using the Service, you grant us a license to:

Store and process your data to provide the Service
Use anonymized, aggregated data for analytics and improvement
Display your configurations within your account

7.4 Minecraft Trademarks

"Minecraft" and "Bedrock" are trademarks of Mojang Studios/Microsoft
Bedrock Commander is an independent third-party tool
We are not affiliated with, endorsed by, or sponsored by Mojang or Microsoft

8. Third-Party Services and Links

8.1 Third-Party Dependencies

The Service integrates with third-party services:

Stripe: Payment processing (subject to Stripe Terms)
Wix: Website hosting (subject to Wix Terms)
Neon & Render: Infrastructure providers

You acknowledge that these third parties have their own terms and privacy policies.

8.2 External Links

The Service may contain links to third-party websites or resources. We are not responsible for:

The availability or accuracy of external sites
Content, products, or services on external sites
Privacy practices of external sites

Access to external links is at your own risk.

9. Disclaimers and Limitations of Liability

9.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation
Accuracy or completeness of content

9.2 No Guarantee of Availability

We do not guarantee that:

The Service will be available at all times
The Service will be free from bugs or errors
Defects will be corrected
The Service will meet your specific requirements
Data will never be lost (though we make reasonable backup efforts)

9.3 Minecraft Server Disclaimer

Bedrock Commander is a management tool only
We are not responsible for your Minecraft server's operation, performance, or data
We cannot guarantee compatibility with all server configurations
Server crashes, data loss, or player issues are not our responsibility
You are responsible for maintaining backups of your Minecraft server data

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEDROCK COMMANDER SHALL NOT BE LIABLE FOR:

Indirect Damages:

Indirect, incidental, special, or consequential damages
Loss of profits, revenue, or business opportunities
Loss of data or server information
Loss of goodwill or reputation
Cost of substitute services

Direct Damages Cap:

Our total liability for direct damages is limited to the amount you paid us in the 12 months preceding the claim
If you're using the free tier, our liability is limited to $10 CAD

Exclusions:

Damages caused by your breach of these Terms
Damages caused by your negligence or misconduct
Losses from sharing your password or account access
Issues caused by third-party services or Minecraft itself

9.5 Jurisdictions That Don't Allow Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bedrock Commander, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another party
Your Minecraft server activities or content
Your breach of any laws or regulations
Any false or misleading information you provide

This indemnification obligation survives termination of these Terms and your use of the Service.

11. Data Backup and Loss

11.1 Your Responsibility

You are solely responsible for:

Backing up your Minecraft server data
Backing up your server configurations
Maintaining copies of important logs or information
Disaster recovery for your servers

11.2 Our Efforts

While we make reasonable efforts to:

Maintain database backups
Prevent data loss
Ensure service reliability

We are NOT responsible for any data loss, corruption, or unavailability resulting from:

Service interruptions or downtime
Software bugs or errors
Third-party service failures
Your account termination
Any other cause

11.3 No Data Recovery Guarantee

We cannot guarantee the ability to recover lost data and are under no obligation to provide data recovery services.

12. Modifications to Terms

12.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may include:

Updates to reflect new features
Legal or regulatory compliance updates
Changes to pricing or subscription terms
Clarifications or corrections

12.2 Notification

When we make material changes:

We will post the updated Terms with a new "Last Updated" date
We may send email notification to your registered email address
We may display a notice on the Service

12.3 Your Acceptance

Continued use of the Service after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the changes:

You must stop using the Service
You may cancel your subscription
No refunds will be provided for disagreement with Terms changes

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

Following account deletion procedures in the Service

13.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

You violate these Terms
You engage in prohibited activities
Your payment fails or chargebacks occur
We suspect fraudulent activity
Required by law or legal process
We discontinue the Service

13.3 Effects of Termination

Upon termination:

Your access to the Service immediately ceases
You lose access to premium features
Your data will be deleted per our Privacy Policy (typically within 90 days)
Subscription fees already paid are non-refundable
Sections 7, 9, 10, 14, and 15 survive termination

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any legal claim, you agree to:

Contact us at support@nerdherdmc.com with a detailed description of the dispute
Give us 30 days to attempt to resolve the issue informally
Act in good faith to reach a mutually acceptable resolution

14.3 Jurisdiction and Venue

If informal resolution fails, any legal action must be brought in the courts of British Columbia, Canada. You consent to the exclusive jurisdiction of these courts.

14.4 Class Action Waiver

To the extent permitted by law, you agree that:

Disputes will be resolved on an individual basis
You waive the right to participate in class actions
You waive the right to participate in collective arbitration
Each party may only bring claims in an individual capacity

15. General Provisions

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Bedrock Commander regarding the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable:

That provision will be enforced to the maximum extent possible
All other provisions will remain in full force and effect

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms:

To an affiliate or subsidiary
In connection with a merger or acquisition
To a successor entity in a sale of assets

15.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

Natural disasters
War, terrorism, or civil unrest
Government actions or regulations
Internet or telecommunications failures
Third-party service outages
Pandemics or public health emergencies

15.6 Survival

Provisions that by their nature should survive termination will survive, including:

Intellectual property rights
Disclaimers and limitations of liability
Indemnification obligations
Dispute resolution terms
General provisions

15.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflicts, the English version prevails.

15.8 Headings

Section headings are for convenience only and do not affect interpretation of these Terms.

We will provide advance notice when reasonably possible

No credits or refunds are provided for planned maintenance
We will make reasonable efforts to minimize disruption

17.3 Export Compliance

You agree to comply with all export laws and regulations. You may not use the Service if you are:

Located in an embargoed country
Listed on any government denied parties list
Subject to export restrictions

17.4 Government Users

If you are a government entity, the Service is a "commercial item" as defined by applicable regulations, and is provided with only those rights granted to commercial users.

18. Acknowledgment

BY USING BEDROCK COMMANDER, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.

If you do not agree to these Terms, you must not access or use the Service.
